Welcome to Shift with Grace (the “Site”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and products, including coaching services and digital downloads (collectively, the “Services”). Throughout these Terms, “we”, “us”, and “our” refer to Shift with Grace, operated through shiftwithgrace.com.au.

By using the Services, you agree to be bound by these Terms. If you do not agree, please do not access or use the Services.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By using our Services, you confirm that you meet these requirements.

2. Services Offered

We offer:

  • 1:1 coaching sessions and programs
  • Digital products (e.g. downloads, PDFs, planners)
  • Free clarity calls and consultations

Services are offered in accordance with the descriptions provided at the time of booking or purchase.

Coaching Disclaimer: Coaching is for personal development and educational purposes only. It is not therapy, counselling, medical, or mental health treatment and should not be relied upon as such. If you are experiencing distress, crisis, or require medical or psychological support, please contact your GP, a qualified mental health professional, or emergency services.

3. Bookings & Payments

All sessions are booked via our website using third-party tools (e.g. Cowlendar on Shopify). Payments are processed through secure providers like Shopify Payments or other platforms we may integrate (e.g. TikTok Shop or Stripe).

You agree to:

  • Provide accurate payment and contact details
  • Pay all charges at the prices in effect when incurred
  • Abide by any session cancellation or refund policy (outlined below)

4. Refund & Rescheduling Policy

We do not offer refunds on digital downloads. For coaching services:

  • Free calls: No-show = forfeit opportunity to rebook
  • Paid coaching sessions: Cancellations must be made at least 24 hours in advance to reschedule. Sessions cancelled with less than 24 hours’ notice will be forfeited.
  • No refunds are issued for unused or partially used coaching packages

We reserve the right to cancel or reschedule services for any reason, including emergencies, illness, or system failures.

5. Confidentiality

All coaching sessions are confidential. Information shared will not be disclosed without your consent, except as required by law (for example, where there is risk of harm to self or others, or legal obligations to report). Recording of sessions is not permitted without written consent from both parties.

6. Intellectual Property

All content on this Site — including course materials, coaching frameworks, digital products, branding, text, graphics, and designs — is owned by Shift with Grace or its licensors and is protected by Australian and international copyright laws.

Any worksheets, guides, or resources provided during or after coaching are for your personal use only and may not be copied, reproduced, distributed, or shared without express written permission.

7. User Conduct

You agree to use our Services only for lawful purposes and not to:

  • Engage in unauthorised commercial activities
  • Use our Services to harass, defame, or harm others
  • Interfere with the proper working of our website
  • Attempt to reverse-engineer or exploit our code, data, or services

8. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and disclose your personal data.

This includes use of tracking technologies such as the TikTok Pixel, which may collect behavioural and transactional data for ad personalisation under maximum-strength settings.

9. Third-Party Services

Our Site may link to or integrate with third-party platforms, including but not exclusive to:

  • Shopify
  • Cowlendar (for bookings)
  • TikTok (for advertising and ecommerce)
  • Meta (Instagram/Facebook) (for advertising and ecommerce)
  • Google (for advertising and ecommerce)

We are not responsible for the content, functionality, or privacy practices of these external services. Use them at your own risk.

10. Disclaimers

The information and services provided by Shift with Grace are for educational and personal development purposes only. We do not guarantee specific results from coaching or digital tools.

To the fullest extent permitted by law, we disclaim any warranties, express or implied, relating to the Services, including but not limited to warranties of fitness for a particular purpose, merchantability, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Shift with Grace shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services, including but not limited to lost profits, data, or emotional outcomes.

12. Indemnity

You agree to indemnify and hold harmless Shift with Grace, its affiliates, and service providers from any claims, damages, or expenses arising out of your breach of these Terms or misuse of the Services.

13. Force Majeure

We are not responsible for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, illness, technical failures, or government restrictions. In such cases, services may be rescheduled without penalty.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes shall be resolved exclusively in the courts of Queensland.

15. Changes to These Terms

We may update these Terms at any time to reflect changes to our Services or legal requirements. Updates will be posted on this page with a new effective date.
